At Endless Acres Consulting LLC, we respect and acknowledge that you have certain rights related to any personal information that we collect from you, and we have certain obligations in respect of the same. By using or accessing our website, applications, services or products (collectively “Services”) in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy and latest edition of the Endless Acres Consulting LLC policy contained within.  You hereby consent that we will collect, use, and share your information in the ways described below.

This Privacy Policy covers our treatment of personally identifiable information (“Personal Information”) that we gather when you are accessing or using our Services. It does not include the practices of companies that we don’t own or control, or people that we don’t manage. We gather various types of Personal Information from our users, and we use this Personal Information internally in connection with our Services, including to personalize, provide, and improve our services, to allow you to set up a user account and profile, to contact you and  allow other users to contact you in the course of fulfilling certain services , to fulfill your requests for certain services, and to analyze how you use the Services. Endless Acres Consulting (“Endless Acres”) provides a platform for generating leads, potential customers, and contact information as a service to its clients (each a, “Client”). This Privacy Policy describes how your personal information is collected, used, shared and safeguarded when you access Endless Acres’ mobile applications, websites, submit opt in forms, services or products (collectively, the “Platform”). Any personal information that you provide via the Platform is collected on behalf of and for the sole benefit of the applicable Client(s) and is subject to their privacy and security practices and policies as well. Endless Acres does not process or disclose your personal information for any purpose other than to provide its services to Clients.

By submitting the contact form and signing up for texts, you willing acknowledge and consent to receive marketing text messages from Land Acres Consulting LLC at the number provided. Consent is not a condition of purchase. Message and data rates may apply. You can unsubscribe at any time by replying STOP to the received SMS (texts) or clicking the unsubscribe link (where available) in the marketing text messages.

Opt-In Information and Third-Party Sharing

We respect your privacy choices, especially concerning the sharing of your personal information. Any information you provide through opt-in consent will not be shared with third parties for marketing or promotional purposes.

PERSONAL INFORMATION WE COLLECT

When you interact with the Platform, we may automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you use the Platform, we may collect information about the individual web pages that you view, what websites or search terms referred you to the Platform, and information about how you interact with the Platform.   • “Log files” track actions occurring on the Platform, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
  • “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Platform.

Additionally, we may collect certain personal information that you provide to us or Client(s) via the Platform from time to time, such as your name or email address.

You are under no obligation to provide us with personal information of any kind, however your refusal to do so may prevent you from using certain features of the Platform. This information is collected to facilitate our staffing and workforce management activities.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We and our service providers use personal information for our legitimate business purposes, including those specifically described below. We engage in these activities to manage our contractual relationship with you, to comply with a legal obligation and/or because we have a legitimate business interest.

We use the personal information that we collect generally to fulfill any requests made through the Platform. Additionally, we use personal information to communicate with you, personalize your experience on the Platform, and, when in line with the preferences you have shared with us, provide you with information or advertising relating to Endless Acres and/or Client(s), which may include their products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize the Platform (for example, by generating analytics about how our users browse and interact with the Platform.

SHARING YOUR PERSONAL INFORMATION

We may share your personal information with third parties to help us use your personal information to provide the Platform, as described above. We may share your personal information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates may include a parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us. We may share your personal information with advisors and actual and potential investors for the purpose of conducting general business analysis. DO NOT TRACK

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will revise this Privacy Policy accordingly.

If you request deletion of your personal information, we will delete your personal information from our active databases following receipt of your verified request; provided, however, that some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our terms of use, and/or comply with legal requirements, and, when we are processing your personal information as a service provider on behalf of a Client, we may submit your request to the Client and follow its lawful instructions with respect to your request.

As a user of Endless Acres’ platform, you have certain rights with respect to your personal information, which we are committed to respecting and facilitating. These rights may include:

  • Right to Access: You have the right to request access to the personal information we hold about you. Upon request, we will provide you with information regarding the categories of personal data we have collected, the purposes of processing, and any third parties to whom your data has been disclosed.
  • Right to Rectification: You have the right to request the correction of inaccuracies in your personal data. If you believe that any information we hold is incomplete or inaccurate, please contact us, and we will promptly update it.

If you no longer wish to receive communications (including, without limitation, email and SMS/MMS messages) from a third party (including Client(s)), you are responsible for contacting the third party directly.

DATA RETENTION

We will retain your personal information for as long as needed or permitted in light of the purpose(s) for which it was obtained. The criteria used to determine our retention periods include the length of time we have an ongoing relationship with you, when we have a legal obligation to which we are subject, or as advisable in light of legal requirements.

We retain personal data for as long as it is necessary to fulfill the purposes for which it was collected. This includes providing our services, managing our contractual relationship with you, and complying with legal obligations.

APPLICABLE LAW, JURISIDCTION, AND FORUM NON CONVENIENS:

This Privacy Policy and any disputes arising from or relating to it, including disputes regarding the collection, use, disclosure, or protection of your personal information, shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or related to this Privacy Policy or your use of our platform (“Platform”) shall be instituted exclusively in the state or federal courts located within the State of Wyoming. You agree to submit to the exclusive jurisdiction of the courts located within Wyoming and waive any objection based on venue or inconvenience of the forum.

THIRD PARTY WEBSITES

The Platform may contain links to third party websites and applications of interest that are not affiliated with us. Once you have used these links to leave the Platform, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot protect the safety and privacy of information that you provide to a third party outside of the Platform. Before visiting and providing any information to any third party websites or applications, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website or application, and should take those steps necessary to, in your discretion, protect the privacy of your personal information. We are not responsible for the content or privacy and security practices and policies of any third parties (including Client(s)), including other sites, services or applications that may be linked to or from the Platform.

SECURITY OF YOUR PERSONAL INFORMATION

We use administrative, technical and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information to us.

LIMITATION OF LIABILITY;

To the fullest extent permitted by applicable law, Endless Acres, its officers, directors, employees, affiliates, agents, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use our platform (“Platform”); (ii) any unauthorized access to or use of our secure servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Platform; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Platform by any third party; (v) any errors or omissions in any content or information provided on or through the Platform; or (vi) any other matter relating to the Platform, even if Endless Acres has been advised of the possibility of such damages.

SEVERABILITY:

If any provision of this Privacy Policy is held to be unenforceable or invalid under applicable law, such provision shall be modified to accomplish the objectives of the provision to the greatest extent possible, and the remaining provisions will continue in full force and effect. Any such modification or deletion of a provision shall not affect the validity and enforceability of the rest of this Privacy Policy.

CHANGES

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last Revised” date at the top of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Platform, and you waive the right to receive specific notice of each such change or modification. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Platform after the date such revised Privacy Policy is posted.

Endless Acres, in its sole discretion, may choose to send email notifications regarding any change to the terms of this Privacy Policy.

MINORS

The Platform is not intended for individuals under 18 years of age. We do not knowingly solicit information from or market to individuals under 18 years of age. CALIFORNIA RESIDENTS

Under the California Consumer Privacy Act of 2018 (“CCPA”), Endless Acres is a “service provider” of the applicable Client(s), which may be a “business” covered by the CCPA. As a “service provider”, Endless Acres processes your personal information in order to provide its services to the Client(s), and in order to facilitate your interactions with the Client(s). To learn more about rights that you may have under the CCPA, such as the right to request information about the types of your personal information that has been collected, the right to request that your personal information be deleted, and the right to opt-out of the sale of your personal information, please contact the applicable Client(s).

Endless Acres and the Platform comply with the CCPA, CAN-SPAM and other applicable laws. If you’d like to make a request to Endless Acres regarding your personal information, please contact us by e-mail at privacy@endlessacresconsultingllc.com, and we will try to accommodate your request unless we are prevented from doing so as a result of applicable law or a significant legitimate interest of Endless Acres. Please also note that, depending on the nature of your request, the fulfillment of your request may hinder or prevent Endless Acres’ ability to provide you with certain features and functionalities of the Platform.
